Terms of Use

Last updated November 6, 2026 · Effective November 6, 2026

These Terms are under legal review and may change before DwellZip launches. If they change, we’ll ask you to accept the new version.

At a glance

1. Agreement and eligibility

These Terms of Use (“Terms”) govern your use of dwellzip.com, its subdomains, and DwellZip’s comparison tools, proposal board and agent accounts (the “Services”), operated by Dwellzip Inc. (“DwellZip,” “we,” “us”), a Michigan corporation. By creating an account or using the Services, you agree to these Terms. If you use the Services for a business, you confirm you’re authorized to accept these Terms for it.

The Services are for businesses and their authorized people, and you must be at least 18. Our Privacy Policy explains how we handle information. Licensed agents and agencies also agree to the Agent Marketplace Agreement, which controls if it conflicts with these Terms.

2. What DwellZip does, and doesn’t do

DwellZip is software that lets employers organize the employee information needed for pricing, see plans priced from the rates carriers file with regulators, model how to split the cost, compare a group plan with an ICHRA allowance, and ask licensed agents for proposals.

DwellZip is a technology provider. We are not an insurance carrier, underwriter, licensed insurance producer, agent or agency, or a financial, tax or legal adviser, and we don’t solicit, negotiate, sell, underwrite or bind insurance. Showing a business its plans and estimates requires a licensed agency of record in its state, which DwellZip checks; that agency is named, with its license, wherever plans are shown.

Agents and agencies are independent businesses, separate from DwellZip. They are responsible for their own licenses, carrier appointments, advice and applications. DwellZip doesn’t guarantee that any agent will respond, how quickly, or the quality of their advice.

3. Prices, estimates and comparisons

Plan descriptions, rates, estimates, cost splits, ICHRA comparisons and other results are general information for comparison. They come from carriers’ filed rates, carrier quotes that agents attach, public data and what you enter, and they may be incomplete, out of date or wrong. DwellZip doesn’t set or change prices. Nothing in the Services is an offer of coverage, a binder, a guarantee of eligibility, or legal or tax advice.

Before deciding, confirm premiums, plan availability, networks, benefits, exclusions, effective dates and eligibility with the carrier or a licensed insurance professional. Only the carrier’s documents and the issued policy govern coverage.

4. ICHRA, ACA and tax tools

ICHRA comparisons, affordability checks, employee classes, full-time-equivalent counts and any other ACA or tax-related tool are aids only. They aren’t a determination by the IRS, the Department of Labor or a state insurance regulator, and DwellZip doesn’t prepare or file tax forms or certify compliance.

Employers are responsible for their plan design, employee classes, allowance amounts, affordability, required employee notices (for an ICHRA, the federal model notice) and tax filings. Check these with qualified benefits counsel, a tax professional or a plan administrator before relying on them.

5. Information you enter

You confirm that what you enter is accurate and that you have the authority to share it, including any notices or permissions the law requires for information about employees and their families. Don’t enter Social Security numbers, medical records, diagnoses or claims; no feature asks for them.

You allow DwellZip to process what you enter as described in the Privacy Policy. An anonymous summary of your group goes to licensed agents only after you agree to it in the Services, and your contact details and employee list go only to your agency of record. You keep ownership of the information you enter.

6. Accounts and security

Keep your password and authenticator device safe; you’re responsible for activity under your account. Tell us right away at [email protected] if you think your account has been misused. We may suspend or limit an account when needed to protect the Services, stop misuse or automation, or meet legal duties, and we’ll tell you when we can.

7. Fees

Business owners use DwellZip free. Agents and agencies pay the subscription described in the Agent Marketplace Agreement and shown before they subscribe; we don’t charge anything that wasn’t shown and accepted first. DwellZip doesn’t guarantee any number of proposal requests, sales, clients or commissions.

8. What you may not do

9. Ownership and license

DwellZip and its licensors own the Services, including their software, design, text and logos. We give you a limited, revocable, non-exclusive, non-transferable right to use the Services for your business. Public information shown in the Services, such as carriers’ filed rates, remains public; you keep ownership of what you enter.

10. Other websites and services

The Services link to carriers, government agencies, sources and other sites, and use outside providers such as our payment processor. We don’t control them and aren’t responsible for their content or how they work.

11. Disclaimer of warranties

To the fullest extent the law allows, the Services are provided “as is” and “as available.” DwellZip disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, accuracy and non-infringement. We don’t promise the Services will be uninterrupted or error-free, or that prices will always reflect a carrier’s latest rates. Nothing in these Terms takes away rights the law doesn’t allow us to exclude.

12. Limitation of liability

To the fullest extent the law allows, DwellZip and its directors, employees and affiliates aren’t liable for indirect, incidental, special, exemplary, punitive or consequential damages, including lost profits, revenue, data or client relationships, arising from the Services.

To the fullest extent the law allows, DwellZip’s total liability for all claims about the Services is limited to the greater of what you paid DwellZip in the 12 months before the claim arose and US $100. This doesn’t limit liability that can’t legally be limited, such as for fraud, gross negligence or intentional misconduct.

13. Your responsibility to us

To the extent the law allows, you’ll defend and compensate DwellZip and its people for third-party claims, losses, fines and costs (including reasonable legal fees) that arise from your unlawful use of the Services, your breach of these Terms, or information you entered without the right to do so.

14. Ending your use

You can stop using the Services at any time and ask us to close your account. We may suspend or end access for unpaid fees, misuse, scraping, a lapsed license or a serious breach of these Terms. Where practical, we’ll give notice and a chance to fix a breach that can be fixed. Information is then kept or deleted as the Privacy Policy describes.

15. Governing law and disputes

Michigan law governs these Terms, without regard to its conflict-of-law rules. Legal proceedings must be brought in the state or federal courts located in Michigan, except where the law gives you a right to bring them elsewhere.

16. Changes and the whole agreement

We may update these Terms. When we do, we’ll post the new version with a new date and ask you to accept it before you keep using your account; earlier versions stay available. If a court finds part of these Terms unenforceable, the rest still applies. These Terms, the Privacy Policy and, for agents, the Agent Marketplace Agreement are the whole agreement about the Services.
